Charles Driver, an inmate at the Limestone Correctional Facility, appeals a circuit court ruling in his drug case. Driver tested positive for marijuana in a routine drug screening. Prison officials ordered a disciplinary hearing when Driver later tested positive in a follow up test. Driver told the disciplinary hearing that he didn't use drugs. His cellmates testified others smoked marijuana while Driver slept in the cell. The hearing concluded Driver violated the facility's drug policy and ordered disciplinary action. Driver filed an appeal. Prison officials responded with a motion to dismiss.

A circuit court granted the motion to dismiss Driver's complaint. Driver now appeals.

Driver loses. The Alabama Court of Criminal Appeals affirmed the circuit court's decision. The appeals court ruled the drug test results supported the original ruling against Driver.
