Golden Eagle Distributors, Inc. appeals the decision of the Arizona Department of Employment Security allowing unemployment benefits for a truck driver who was discharged for a positive urinalysis. Golden Eagle argues that federal law dictates that an employee who has tested positive for drugs may not operate a motor vehicle. The employee, Jose Lucero, tested positive for cocaine during the workday.

Appeals Board of the Arizona Department of Economic Security ruled that Lucero was eligible to receive benefits after he was discharged by Golden Eagle.

Golden Eagle wins. The court of appeals finds that the agency's appeals board erred in its ruling. The court reverses the ruling.
