Case Summary:
Leonel Tarango appeals an administrative law judge's ruling on a matter of evidence in his deportation hearing. Officials with the Immigration and Naturalization Service moved to deport Tarango following his conviction on drug charges and other criminal violations. Tarango argued the INS lacked jurisdiction over an aspect of his case. He also attempted to eliminate consideration of his drug conviction. An initial hearing concluded the evidence should be considered and ruled the deportation proceedings could advance. Tarango appealed the ruling.
Decision of lower jurisdiction:
The Board of Immigration Appeals refused to support Tarango's attempts to suppress evidence of his drug conviction. The board affirmed the hearing officer's ruling. Tarango now appeals.
