A former flight attendant for United Airlines appeals a lower court's ruling in his suit against the airline and his former union. Frank Barnett filed a grievance through his union after the airline adjusted his seniority status. Barnett argued the revision violated an existing collective bargaining agreement. An arbitration board rejected Barnett's grievance. Barnett subsequently filed suit against the airline and the union. The defendants responded with separate motions for summary judgment.

The U.S. District Court for the District of Colorado granted the defendants' motion for summary judgment. The court ruled the statute of limitations expired on Barnett's case before he filed suit. Barnett now appeals.

Barnett loses. The U.S. Court of Appeals for the Tenth Circuit affirmed the decision of the lower jurisdiction. The appeals court ruled the lower jurisdiction correctly dismissed Barnett's case.
