The plaintiff, using the pseudonym of Jane Roe, challenges a specific provision of her employer's new drug and alcohol testing program. Roe argues that a questionnaire used in the collection process violates provisions of the Americans with Disabilities Act by requiring employees to disclose doctor-prescribed medications. Roe contends the questionnaire also violates her common law right to privacy. Both sides in this dispute filed motions for summary judgment.

This is the first judicial review of this case.

A split decision The United States District Court for the District of Colorado ruled that the company's policy violated provisions of ADA. However, the court ruled that the company did not violate Roe's privacy rights.
