James McGann seeks custody of his son as part of his court divorce decree. McGann cites his successful completion of drug rehab and his employment history as reasons supporting his custody bid. McGann argued that his wife 's continued drug use and failure to complete drug rehab as supporting factors.

This is the first judicial review of this case.

McGann wins. The Superior Court of Connecticut , Hartford/New Britian, awarded joint custody to both parents with primary physical custody to the father. As part of the divorce decree, McGann was ordered to pay for half of the cost of future drug tests involving his former wife.
