Officials with the American Federation of Government Employees file suit to block a plan to randomly drug test union employees at the U.S. Department of Transportation. The union contends random drug testing constitutes an unreasonable search and an invasion the of the individual employee's privacy rights. The department responded with a motion for summary judgment.

This is the first judicial review of this case.

The DOT wins. The U. S. District Court for the District of Columbia granted the DOT's motion for summary judgment. The court noted the department's plan included steps to protect the privacy of individual employees. The court instructed the department to maintain complete and secure records on every test performed and of any action taken based on a positive test result.
