Union issues, arbitration, collective bargaining.

A union representing workers at a private company appeals a decision of the National Labor Relations Board. The union challenged the company's decision to relocate operations to another facility and fill positions there with nonunion workers. The union argued the decision violated an existing collective bargaining agreement. The union and company officials negotiated until they reached an impasse. The union subsequently submitted the issue to the NLRB.

The NLRB initially ruled in favor of the union, ordering the company to reverse all action related to its decision to move its operations. The company filed an appeal to NLRB ruling. While a court considered the company's appeal, the NLRB submitted a motion to remand the issue back to the board. The court granted the NLRB's motion. Upon further review, the NLRB reversed itself and permitted the company to move ahead with its plans. The union now appeals.

The union loses. The U. S. Court of Appeals for the District of Columbia Circuit affirmed the ruling of the NLRB. The court ruled the company displayed no anti-union sentiments in its decision. The court also ruled the NRLB made no reversible errors in its handling of the case.
