Case Summary:
Duane Craft seeks an injunction, blocking his dismissal from the Pace Bus Company. Craft, a maintenance worker, was terminated when he tested positive for marijuana in a drug screening. Pace alleges that the drug screen was proper, pursuant to various provisions of its' employment policy.

The U.S. District Court for the Northern District of Illinois, Eastern Division rejected Pace's contention that Craft had a limited privacy expectation due to the nature of his employment. The court noted that Craft was employed as a maintenance man, not a bus driver. The court found that Craft may have been subject to a drug screen if the agency could demonstrate cause for reasonable suspicion. The case was remanded back to the lower court for additional review.
