Issues:
Evidence, disparate treatment, attorney practices.

Case Summary:
Officials with the Equal Employment Opportunity Commission petition the court to block introduction of evidence of past drug use by individual workers who have filed a sexual harassment suit against their employer. The EEOC argued the evidence is not pertinent to the case before the bench and would only distract the jury from the real issues at hand.

Decision of lower jurisdiction:
This is the first judicial review of this case.

Outcome:
EEOC loses. The U.S. District Court for the Northern District of Illinois ruled that it could not rule on the value of the evidence outside the context of the case. The court stated that it would rule on individual objections as they might be raised during the course of the trial.
