Rodman Atkins, a former bus driver with the Indianapolis Public Schools, files a discrimination suit against the Board of School Commissioners of the City of Indianapolis. The board terminated Atkins after he refused to submit to a drug test. The test was ordered after witnesses reported seeing Atkins allegedly smoking marijuana and consuming alcohol on the job. Atkins filed suit, arguing that his dismissal was racially motivated. The school board responded with a motion for summary judgment. Atkins later countered with a motion to dismiss affidavits submitted by the a board. member.

This is the first judicial review of this case.

The school board wins. The U.S. District Court for the Southern District of Indiana, granted the school board's motion for summary judgment in part. The court granted the board's motion to strike Atkins' affidavit and also denied Atkins' motion to strike the affidavit of a school board member.
