Case Summary:
Employees of a former SCM Office Supplies facility file suit against AMPAD Corporation, the new owner of the plant. Shortly after purchasing the facility from SCM, officials at AMPAD notified all employees they would have to complete employment applications and submit to drug tests, if they wished to be considered for continued employment. Several of the employees filed suit, claiming the company violated the law by not providing advanced notice of a massive lay-off or plant closing. The employees petitioned for summary judgment of their complaint. Company officials responded with a motion for summary judgment, asserting that the plant was never shut down and they never intended to execute a mass layoff.
 
Decision of lower jurisdiction:
This is the first judicial review of this case.
 
Outcome:
The employees lose. The U.S. District Court for the Northern District of Indiana granted the company's motion for summary judgment.
