Case Summary:
Peter Predka appeals his conviction on drug possession charges Authorities stopped Predka's vehicle for speeding. The officer responsible for the stop later testified that he smelled a strong odor of marijuana when he approached Predka's vehicle. The officer subsequently received Predka's sign consent to search the vehicle. The officer discovered six bales of marijuana and a $2,147. The officer arrested Predka and charged him with possession with intent to deliver and failure to possess a state drug tax stamp. Predka claimed the officer asked him to sign the consent form after the search was performed and that he was not fully aware of what he was asked to sign.
 
Decision of lower jurisdiction:
A trial court found Predka guilty of both charges. The court ordered Predka to forfeit the seized currency and his vehicle. Arguing the officer lacked probable cause to stop him, Predka now appeals.
 
Outcome:
Predka loses. The Supreme Court of Iowa affirmed the ruling of the lower jurisdiction. The court stated Predka's complaint lacked merit.
