Issues:
Americans with Disabilities Act, privacy, policy and procedure, drugs, due process.

Case Summary:
William Scott, a nurse, filed suit against his former employer, Edwardsville Manor, claiming he was dismissed in violation of the Americans with Disabilities Act. Edwardsville officials terminated Scott's employment when they discovered state-ordered restrictions against his nursing license. Scott failed to disclose the restrictions at the time he applied for employment with Edwardsville. The restrictions prohibited Scott from administering or having access to narcotics and mood-altering substances. The sanctions were placed on Scott's license due to a past episode of substance abuse. Scott filed a complaint with the Equal Employment Opportunity Commission, claiming protection under the ADA. Officials at Edwardsville responded with a motion for summary judgment.

Decision of lower jurisdiction:
This is the first judicial review of this case.

Outcome:
Scott loses. The United States District Court for the District Of Kansas granted the employer's motion for summary judgment. The court ruled Scott was ineligible for ADA protection.
