The widow of an employee who was killed while driving a company-owned vehicle appeals a lower court's ruling concerning her effort to secure workers' compensation benefits. Foster Woosley, an employee of Central Uniform Rental, died in a one-vehicle accident involving his employer's truck. A post-accident test was performed on Woosley and determined that he was intoxicated at the time of the accident. Woosley's widow filed a claim for workers' compensation. A state board granted benefits, but the award was contested by the former employer.

A circuit court overturned the ruling of the state's benefits board. The court ruled that the company introduced an overwhelming amount of evidence indicating Woosley's intoxicated state contributed to the fatal crash. Woosley's widow now appeals.

Woosley loses. The Kentucky Court of Appeals affirmed the decision of the lower jurisdiction.
