Case Summary:
Officials at Laboratory Specialists, Inc., appeal a lower court's ruling in a suit filed against the laboratory. David Elliott filed suit against Laboratory Specialists after laboratory officials reported to Ellott's employer that he had tested positive for marijuana. Elliott was terminated for violating his employer's drug policy. In fact, the laboratory reported incorrect information. Elliott filed suit against the laboratory. The laboratory argued it had no contract with Elliott and therefore, could not be held responsible for reporting incorrect information to his employer.
Decision of lower jurisdiction:
A trial court jury ruled in favor of Elliott and awarded him $25,000. Officials at Laboratory Specialists now appeal.
Outcome:
Elliott wins. The Louisiana Court of Appeals, Fifth Circuit, affirmed the ruling of the lower jurisdiction. The court ruled that the laboratory was obligated to analyze and report Elliott's test results in a responsible and professional manner.
