Private right of action.

Linda Molesworth, a veterinarian, sues her former employer for wrongful discharge based on sexual discrimination. Molesworth argued she was told at the time she was dismissed that she was being let go because she was a woman. The practice specialized in treating thoroughbred racehorses and Molesworth was told the predominantly male clientele expressed difficulty in working with her. Molesworth subsequently filed suit.

A circuit court jury decided in favor of Molesworth and awarded damages. During the trial Brandon, the former employer, asked the judge to issue specific instructions to the jury. The judge rejected the request. Brandon now appeals, contending the judge erred in his ruling on the special instructions.

A split decision. The Maryland Court of Appeals affirmed in part and reversed in part. The court said the circuit court properly rejected Brandon's request for specific instructions to the jury, but erred when it ruled that Brandon could not present his arguments minus the special instructions. The case is remanded for additional action.
