Issues:
Americans with Disabilities Act, policy and procedure, discrimination, Equal Opportunity Employment Commission.

Case Summary:
Robert B. Campbell, Jr. files suit against Federal Express Corp. for discrimination under the Americans With Disabilities Act, charging that FedEx refused to hire him because of his disability. Campbell had severely injured his hand in an industrial accident several years before and, although he was employed and pronounced fit to work for a competitor, FedEx doctors said his hand grip was not strong enough to maintain control over a steering wheel. Campbell had quit his job at the competitor before receiving a confirmed employment offer from FedEx. The company responds with a motion for summary judgment.

Decision of lower jurisdiction:
This is the first judicial review of this case.

Outcome:
Campbell loses. The U.S. District Court for the District of Maryland granted the company's motion for summary judgment. The court noted that Campbell's complaint was covered by the language of the rules of the Department of Transportation, not the ADA.
