Case Summary:
Officials at the Minneapolis Star Tribune, a daily newspaper, appeal an administrative law judge's ruling on the newspaper's revised drug testing policy. The union representing workers at the newspaper challenged a decision by the newspaper's management to include pre-employment drug testing in the company's hiring procedures. Union officials argued the decision effectively revised an existing collective bargaining agreement and should have been submitted to the union prior to implementation. Union officials were unsuccessful in their efforts to discuss the issue with the newspaper's management. The union filed a grievance on the dispute.
 
Decision of lower jurisdiction:
An administrative law judge ruled in favor of the union. The judge determined the newspaper's action constituted a violation of the existing collective bargaining agreement. The judge ordered the paper to take appropriate action. The newspaper now appeals.
 
Outcome:
The union wins. The National Labor Relations Board affirmed the administrative law judge's ruling. The NLRB ordered the newspaper to cease and desist from refusing to bargain in good faith with the union on the issue of revising the current agreement.
