Russell McDaniel files suit against his former employer, the Mississippi Baptist Medical Center, claiming a violation of the Americans with Disabilities Act. McDaniel, a recovering addict, worked as a marketing representative at the center. McDaniel experienced a relapse and voluntarily checked himself into the treatment center. After he successfully completed a treatment program, officials at the center terminated his employment. They told McDaniel he violated the center's employment policy, which mandated sobriety in the workplace. McDaniel subsequently filed suit, claiming a violation of the ADA. McDaniel also asserted the center never informed him of the employment policy.

This is the first judicial review of this case.

McDaniel loses The U.S. District Court for Southern District of Mississippi, Jackson Division, ruled McDaniel failed to sufficiently support his complaint. The court dismissed the case.
