Lonnie Proffitt filed suit against his former employer, the International Paper Company, after company officials terminated his employment. Company officials enacted a new policy which provided for medical exams for all employees. The union representing many company employees endorsed the policy. Proffitt refused to answer several questions in a questionnaire used during the review process. The company provided him an alternate form to complete, but he refused to complete that form. Company officials subsequently terminated Proffitt's employment. He later filed suit, claiming the company violated his privacy. The company responded with a motion for summary judgment.

This is the first judicial review of this case.

Proffitt loses. The U.S. District Court for the Southern District of Ohio granted the company's motion for summary judgment and dismissed the case.
