Case Summary:
The Oregon Department of Corrections appeals a state labor board's ruling on an issue involving drug testing. When the department refused to bargain the issue of drug testing with the Federation of Oregon Parole and Probation Officers, the union field a grievance alleging an unfair labor practice with the state's Employment Relations Board.
Decision of lower jurisdiction:
The EAB ruled in favor of the union and determined that the department was guilty of an unfair labor practice. The board ruled that a drug testing program was covered by the restraints of a collective bargaining agreement. Therefore, the department is compelled to negotiate the dispute. The department now appeals.
