Case Summary:
Milo Christensen appeals the ruling of a state board that denied him unemployment benefits. Christensen was dismissed from his position with the Bingham-Willamette Company following a relapse with alcoholism. The company knew Christensen was a problem drinker when he was hired and he was hospitalized for treatment during his third year of employment. When Christensen was awarded unemployment benefits, the company appealed to the Oregon Employment Appeals Board.
Decision of lower jurisdiction:
The EAB reversed on appeal and denied benefits. The board said Christensen had previously demonstrated his ability to control his drinking. Therefore, he was solely responsible for his relapse. Christensen now appeals.
