Arlene Swanson, executrix of the estate of David Swanson, petitions the court to have her suit against McNeil, PPC, Inc., remanded to a county court. Swanson filed suit against McNeil, the manufacturer of Tylenol, alleging that the company failed to warn consumers that Tylenol could pose a risk to those who regularly consume alcohol. The company contends that this case should be heard in Idaho, the state where the fatality occurred. The company has significant holdings in Pennsylvania.
