Drug testing, due process, dismissal, Fourth Amendment

Christopher Frederick, a former employee of the Southeastern Pennsylvania Transportation Authority, petitions the court to rehear his suit against the authority. Frederick posted a positive result in an mandatory drug test. He contends his due process rights were violated because he did not receive a hearing related to his pre-termination suspension. The authority responded with a motion for summary judgment.

The United States District Court for the Eastern District of Pennsylvania granted the authority's motion for summary judgment. Frederick now petitions the same court to rehear his case.

Frederick loses. The district court rejected the petition to rehear the case. The court ruled Frederick's petition contained no new facts or information.
