Case Summary:
The owner of a race horse petitions the court for establishment of a three-judge panel to review an order of suspension that was handed down by the Puerto Rico horse racing board. The board ordered the horse suspended from racing on suspicion that it had been doped. The board responded with a motion to dismiss. A temporary restraining order was issued while the petition received judicial review.
Decision of lower jurisdiction:
This is the first judicial review of this case.
Outcome:
The racing board loses. The U.S. District Court for the District of Puerto Rico denied the racing board's motion to dismiss and ordered continued enforcement of the existing restraining order. The court ordered the establishment of a three-judge panel.
