Case Summary:
Clayton A. Holmes, a member of the Dallas Cowboys football team, files suit against the National Football League and the NFL management council, charging that a drug test he failed was knowingly misrepresented to him. Based on the test results, Holmes was required to enroll in a treatment program, and received a four-game suspension without pay. The NFL filed a motion to dismiss the case.
Decision of lower jurisdiction:
This is the first judicial review of this case.
Outcome:
Holmes loses. The U.S. District Court for the Northern District of Texas, Dallas Division, granted the NFL's motion to dismiss the case. The court noted that "it simply cannot be determined whether the [drug test] was the result of fraud-which is the linchpin of all [Holmes'] state-law claims."
