Negligence, employer liability.

H.E. Buchanan appeals a lower court's ruling on his suit against a truck driver who had hit a bridge and damaged the structure. Buchanan's wife was injured when she attempted to cross the damaged bridge. Buchanan claims that the truck driver should have set up some type of warning about the damaged bridge.

The trial court ruled in favor of the Buchanans, stating that the defendant had a duty to warn others of the conditions of the bridge. Upon appeal, the appellate court reversed the judgment of the trial court and entered a finding for the defendant. Buchanan now appeals.

Buchanan loses. The Supreme Court affirmed the decision of the appellate court. The higher court ruled that the defendant had no duty to warn others of the condition of the bridge because the damage to the structure was not caused by the negligence of the driver or his employrer.
