Bobby Shelton appeals his conviction on charges of possession of cocaine with intent to distribute. Police charged Shelton with possession after seeing him throw a plastic bag of the drug out the window of his car.

A trial court rejected Shelton's effort to suppress evidence. Shelton tried to argue that the court erred in admitting the charge of possession with intent to distribute. He asserted that prosecutors failed to demonstrate that the amount of cocaine in his possession was for distribution and not personal consumption. Shelton was convicted on charges of possession with intent to distribute. Shelton now appeals.

Shelton loses. The Virginia Court of Appeals affirmed the ruling of the lower jurisdiction. The appeals court ruled that the trial court addressed the issues in this case in an appropriate manner.
