Case Summary:
Horace E. Banks files a habeas corpus petition to the circuit court to overturn a conviction for cocaine possession with the intent to distribute. Banks was convicted in 1990 and sentenced to serve 20 years. His appeals to the court of appeals and supreme court were denied, but his motion to file a state Habeas corpus petition was granted. Banks alleged ineffective defense counsel, insufficient evidence and other claims.
