Case Summary:
The Equal Employment Opportunity Commission seeks a court order to force the City of Milwaukee and the Milwaukee Police Department to comply with a subpoena issued by the EEOC. The agency was investigating alleged racial discrimination against officers and officer candidates in the police department. The EEOC subpoenaed records from the department, including officers' medical records and drug testing results. Department officials objected to releasing the records, arguing the release would compromise internal investigations.
 
Decision of lower jurisdiction:
This is the first judicial review of this case.
 
Outcome:
A split decision. The U.S. District Court for the Eastern District of Wisconsin granted enforcement of most of the subpoena, including the medical and drug testing records. However, the court did not grant enforcement on several subsections of the subpoena the court deemed too ambiguous or not relevant to this discrimination investigation.
